Public consultation on guidelines on export of cyber-surveillance items

The EU Dual Use Regulation (EU) 2021/821 that entered into force in 2021 introduced a new definition of cyber-surveillance items. The authorities were given the possibility to make export of cyber-survaillance items subject to authorisation. Exporters were obligated to monitor whether a risk exists that the items in question will be used in connection with serious violations of human rights or international humanitarian law. Exporters must report their suspicions to the competent authority, which in Finland is the Ministry for Foreign Affairs.

The European Commission has been preparing guidelines for exporters on the export of cyber-surveillance items. A public consultation on the guidelines is open at the website of the European Commission(Link to another website.). The draft guidelines are available at the same website.

The consultation is open until 9 June 2023.
