EU opens targeted consultation to evaluate Dual-Use Regulation

The European Commission invites all stakeholders to contribute to the consultation on the overall evaluation of Regulation (EU) 2021/821 (the Dual-Use Regulation).

Under Article 26(4) of the Dual-Use Regulation, the Commission must carry out an evaluation of the regulation and report on the main findings to the European Parliament, the Council and the European Economic and Social Committee.

The evaluation will examine whether the regulation has achieved its intended objectives

The purpose of the overall evaluation of the Dual-Use Regulation is to examine whether the regulation has achieved its intended objectives to contribute to international peace and security by preventing the proliferation of weapons of mass destruction and ensuring respect for fundamental rights and international humanitarian law.

Another objective is to examine whether the regulation has minimised unnecessary burden on legitimate trade, ensured a level-playing field for exporters in the single market and enhanced the global competitiveness of EU dual-use industries. The evaluation will also consider whether the regulation has promoted innovation and international research collaboration.

Stakeholders’ insights are essential

A robust overall evaluation process requires participation by a wide range of stakeholders and the collection of high-quality information. Stakeholders’ insights are essential to identify potential shortcomings in the current export control system, assess compliance challenges and explore improvements.

The consultation has been published on the European Commission’s website and has the deadline of 11 September 2026.
