New information about the effects of the United Kingdom's exit from the European Union on the export of dual-use items

The UK has clarified the principles relating to the export of dual-use items from the country from 1 January 2021 onwards.

The Border with the European Union(Link to another website.) (Opens New Window), which was published by the UK Government on 13 July 2020, outlines the processes the UK plans to apply to the export of dual-use items after the period for the UK’s withdrawal from the European Union has expired at the turn of the year. Guidance relating to dual-use items is given on pages 175–176 of the document.

Dual-use items can be exported from the UK to the EU without a licence until the end of this year.

From 1 January 2021, traders will be able to export dual-use items from the UK to the Member States of the European Union in a simplified declaration procedure under the Open General Export Licence (OGEL) of the UK, with the exception of goods that require an export licence for transfer between the EU Member States.  

The current version of the EU Control List of Dual-Use Items can be accessed here(Link to another website.) (Opens New Window), but the list is updated annually, usually in December. The open general licence (OGEL) can be applied for these goods subject to the restrictions set in the conditions included in the OGEL.

A list of the goods for which an export licence is required even for transfer between EU Member States, can be found on pages 246–354 of the Finnish version of the above-mentioned EU Control List of Dual-Use Items. An individual licence must be applied for from the UK prior to exporting these goods to EU Member States.

Export licences which have been granted by any EU Member State, including Finland, and which have been used for exporting goods from the UK to countries outside the European Union, will expire at the turn of the year. Companies, which export goods from the UK to countries outside the European Union, must apply for new export licences to these exports from the UK.

The EU will provide more detailed information about the principles applying to the export of dual-use items to the UK from 1 January 2021 onwards at a later date.  

As an EU Member State, Finland complies with the European Union legislation on the export of dual-use items together with the complementary national legislation. 

We will give more information about the principles on the export of dual-use items from EU Member States to the UK to be observed by the EU from 1 January 2021 onwards.  Possible complementary guidance on practical measures to be taken by Finland will be given in the same context.
